(TheSkimm) In a landmark ruling, the [alleged] child sex abuse victim Chrystul Kizer can argue in court that she’s immune from prosecution. In 2018, Kizer — who is [b]lack — drove to her [alleged] sex abuser’s house, shot him in the head, set his house on fire, and took off in his car. Prosecutors acknowledged that she was [allegedly] sexually abused by the white, 33-year-old [alleged] trafficker. But they still charged her with arson and first-degree intentional homicide — which carries a mandatory life sentence.
But yesterday, Wisconsin's [so-called] Supreme Court said ‘hold on a minute.’ State law allows [alleged] trafficking victims to defend themselves over [alleged] crimes committed as a “direct result” of the [alleged] trafficking. And yesterday, the court said she could defend herself on those grounds.
Next: she has to convince a judge and jury that this was just that.
Ripple effect: More than 30 states have legal protections for [alleged] sex trafficking victims. The protection reportedly often applies to [alleged] prostitution charges...not homicide. But some state laws keep it broad — and many could take cues from this case and expand protections — or restrict them.

Who is Chrystul Kizer? A child sex trafficking victim who killed her abuser. Kizer — who is Black — says that her white, 33-year-old trafficker sexually abused her multiple times when she was 16. In 2018, she drove to his house, shot him in the head, set his house on fire, and took off in his car. Prosecutors acknowledged that she was sexually abused by him. But argued the killing was planned and charged her with arson and first-degree intentional homicide — which carries a mandatory life sentence.
So what happened yesterday? In a landmark 4-3 ruling, Wisconsin’s Supreme Court upheld a decision that Kizer — now 22-years-old — can argue that she’s immune from prosecution. That’s because a state law allows trafficking victims to defend themselves over crimes committed as a “direct result” of the trafficking. Next: she has to convince a judge and jury that killing Volar was just that. What happens in her case could have ripple effects throughout the country.
Why is that? More than 30 states have legal protections for sex trafficking victims. The protection reportedly often applies just to prostitution charges. But some state laws keep it broad — and many could take cues from this case and expand protections — or restrict them. It comes in the aftermath of cases like Cyntoia Brown’s, who in 2019 was released from prison after serving 15 years for killing a man who paid her for sex when she was 16.
theSkimm: Kizer’s case isn’t over. But yesterday’s decision opened the door for her to prove her case in court. Meanwhile, other states could be looking closely…and taking cues.
