(Sportico) U.S. Supreme Court Justice Amy Coney Barrett’s denial of an emergency application to bar Indiana University from requiring faculty, staff and students be vaccinated from COVID-19 is an important legal development for college athletic departments. The denial, issued last Thursday in Klaassen v. Trustees of Indiana University, suggests that athletes and other students who challenge vaccine requirements would likely fail.
Barrett reviewed the application, filed by eight students, as the circuit justice for cases from the Seventh Federal Circuit (covering Indiana and other Midwestern states). Emergency applications are handled “on paper,” meaning without a hearing.
Barrett’s denial is not tantamount to a decision on the merits, and it lacks the precedential impact of a Supreme Court ruling. A group of students or athletes from a college located in a different federal circuit could mount a similar challenge that is reviewed by a different justice who might, unlike Barrett, refer it to the full Court for consideration. Yet assuming Barrett’s views reflect a majority of the justices, COVID vaccine directives for the 2021-22 academic year will be seen as lawful conditions.
Barrett’s order omitted analysis and reasoning. However, under Court procedure, she would have granted an injunction only upon identifying a fair prospect that most of the justices would find a lower court’s ruling erroneous and that irreparable harm would otherwise occur.
The eight students insist the vaccine requirement violates their 14th Amendment due process rights and infringes on their ability to make medical decisions. They cite numerous cases, including Roe v. Wade, for the proposition that the government—and, by extension, public universities—must meet a heightened standard of review when it “interferes” with a right to bodily integrity and autonomy.
Earlier this month, a three-judge panel on the 7th Circuit rejected the students’ arguments. Judge Frank Easterbrook cited as precedent the U.S. Supreme Court’s 1905 ruling in Jacobson v. Massachusetts. It holds that states can require members of the public be vaccinated against smallpox.
Easterbrook stressed that Indiana University’s policy contains accommodations, including for religious beliefs, online-only learning and a documented allergy to the vaccine. He also underscored the school’s policy only applies to those who enroll—not the general public—and that students “who do not want to be vaccinated” can pursue enrollment at a college that doesn’t require the vaccine. Easterbrook further highlighted that universities have an established tradition of requiring vaccinations “to keep other students safe in a congregate setting,” with “common” vaccine requirements for measles, mumps, rubella, diphtheria, tetanus, pertussis, varicella and meningitis.
Attorneys for the students found these conclusions unpersuasive. They maintain the three COVID vaccines available in the U.S. (Pfizer, Moderna and Johnson & Johnson) are, unlike vaccines for other diseases, not fully approved by the Food and Drug Administration. They received emergency use authorization, which follows a speedier but less comprehensive review. The attorneys, who practice at the Bopp Law Firm in Indiana, also insist that a COVID vaccine is unnecessary for college students. To that end, they assert, “the risk of serious morbidity and mortality from COVID for those under 30 is virtually zero.” The attorneys add arguments that some people suffer vaccine side effects and that studies suggest the vaccines are less effective for the Delta variant, which has become the most prevalent strain in the U.S.

(Ozy) Shocking Scenes at Airport as Afghans Try to Flee
Searing images were broadcast from Kabul’s international airport yesterday, where thousands of desperate Afghans flocked to try to get flights out of the Taliban-occupied country. Footage showed people clinging to the fuselage of departing U.S. jets, which continued to take off with people then falling from the sky. At least six people were SUPPOSEDLY killed in the chaos, which revealed the terror many feel after the militant group’s takeover. U.S. President Joe Biden defended his withdrawal, saying only that the fall to the Taliban happened faster than expected. Today, evacuation flights resumed as Taliban leader Amir Khan Muttaqi was in talks to form a government. (Sources: NYT, Washington Post, The Guardian / Ozy)
THE SETUP FOR REFUGEES
(TheSkimm) Thousands of people are desperately trying to get out of Afghanistan.
Earlier this week, the Taliban seized Kabul, the country’s capital of about 5 million people (I THOUGHT IT WAS 6). The rapid takeover left the world stunned. That includes the thousands of Afghans who fled their homes and believed that Kabul – a city with US troops and western presence – would be a safe haven. But when the Taliban took control of the city, thousands of Afghans rushed to Kabul’s international airport, where international evacuation flights were taking off. And things quickly spiraled into chaos.
Crowds stormed past security forces. Hundreds flooded the tarmac, trying to get on departing planes – including a US military jet. At least seven people died amid the chaos. Some reportedly fell from mid-air.Land border crossings are apparently under the Taliban’s control and banks closed throughout Kabul. But many are still trying to escape via flights. And have been trying to get passports and visas. Canada, Albania, and Kosovo are accepting refugees. And in the US, the Pentagon’s reportedly looking to house refugees in Wisconsin and Texas. But amid embassy closures, thousands are still struggling to get to safety.
The US is working to get up to 30,000 Afghans under the special visa program out of Kabul. But US lawmakers are calling for more, and pleading with the Biden admin to speed up the evacuation of US citizens and Afghan allies. Many were still baffled by the admin's unpreparedness. (Think: Even during the fall of Saigon, US helicopters landed every 10 minutes and evacuated over 7,000 people in less than a day.) But President Biden doubled down on the withdrawal decisions...and the timeline. Despite the “gut-wrenching” situation, Biden said the US shouldn’t defend a country that isn’t “willing to fight” for itself. And said the Afghan gov worried that pulling out earlier would've triggered a "crisis of confidence.”

US Military Bases to House Thousands of Afghan Refugees in Coming Days
(The Epoch Times) The United States is preparing to accommodate thousands of Afghan refugees in the coming days on American military installations while evacuating Americans from the country now controlled by the Taliban terrorist group.
“We want to have the capacity to get up to several thousand immediately, and want to be prepared for the potential of tens of thousands,” Pentagon Press Secretary John Kirby told Fox News on Sunday. “[Forts] Bliss and McCoy have the capability right now—and what’s advantageous is with a little bit of work, they could increase their capacity in very short order.”
Fort Bliss is a military base in El Paso, Texas, and Fort McCoy is in Wisconsin.
Kirby also implied that American citizens would not always be prioritized over Afghan Special Immigrant Visas (SIV) applicants.
“Once we get more airlift out of Kabul, we’re going to put as many people on those planes as we can. There will be a mix, not just American citizens, but perhaps some Afghan SIV applicants as well,” Kirby said. “It’s not going to be just Americans first, then SIV applicants. We’re going to focus on getting as many folks out as we can.”
Lieutenant Colonel Chris Mitchell, a spokesperson from the Defense Department, told The Epoch Times that Defense Secretary Lloyd Austin approved two requests for assistance from the State Department on Sunday to transport and temporarily house Afghan SIV applicants, their families, and other individuals at risk.
“Under the first request, the Department will provide temporary housing, sustainment, and support inside the United States for up to 22,000 Afghan SIV applicants, their families and other at-risk individuals. The US Northern Command will coordinate details with the State Department, the Department of Homeland Security, and the Department of Health and Human Services, as necessary. This support will be provided under Presidential Drawdown Authority to the maximum extent possible, with additional support being provided on a reimbursable basis,” Mitchell said via email.
“Under the second request, the Department will provide protection, air transportation, and processing of up to 30,000 at-risk individuals from Kabul. This total includes embassy personnel, US citizens, Afghan SIV applicants, and other at-risk individuals,” Mitchell continued.
Mitchell said 8,000 of those would be transported to a third country for processing, with an additional 22,000 being transported to the United States. The Department of State will be responsible for onward travel for all transported individuals.
The Department of State didn’t immediately respond to a request from The Epoch Times for comment.
In a joint statement issued Sunday, the two departments asserted they would work together to evacuate Americans and Afghan refugees to the United States in the coming days.
“And we will accelerate the evacuation of thousands of Afghans eligible for U.S. Special Immigrant Visas, nearly 2,000 of whom have already arrived in the United States over the past two weeks. For all categories, Afghans who have cleared security screening will continue to be transferred directly to the United States. And we will find additional locations for those yet to be screened,” the statement reads.

Americans Will Need Third Vaccine Shot
After initially recommending vaccine boosters for at-risk populations, the Biden administration has decided all Americans should get a third shot. With the delta variant causing cases to surge across the nation, people might need additional protection some eight months after getting their second shot. People who got the one-dose Johnson & Johnson vaccine will also likely require a booster. Some scientists say this is necessary as the vaccine’s effects may start to wane over time. The new policy, likely to be announced this week, will depend on the Food and Drug Administration’s approval. Third shots could be offered by mid-September. (Sources: Washington Post, NYT)
